yes you can ask, best to ask in an informal manner though. And the employee's answer is not legally binding. She may ay that she is not returning to work but if she suffered a stillbirth, say, then she might want to change her mind. therefore the law allows a period of time afterwards.
if you are the employee then I would suggest finding a good temp agency and hiring a temp to cover the job for the maternity period - if the employee decides not to return you have a ready made replacement.

When a woman goes off on Maternity Leave she has to tell her Employers how long she will be off, between 6 and 12 months, if she intends to come back. Then at least a month before her 'return' she has to let her Employers the date she will be.

Tell them yes, even if your not. You won't be obligated and you will pick up where you left off if you return.
By refusing to answer or delaying an answer you have in fact answered their question.
If you decide to return after a delayed answer or citing your rights you will be branded as a trouble maker with a bad attitude, not committed etc..
Having the right to not answer something doesn't mean it will help your career and most likely hurt you at that firm.
