The laws for Hawaii state that male and female can have consensual sex at 16 so NO, you cannot be charged for statutory rape.
BUT, both of you are too damn young to be going there in the first place....well, SHE is anyway. If you don't want this mother on your ***, even if she can't charge you, then keep it in your pants.

Statutory rape is illegal sexual activity between two people when it would otherwise be legal if not for their age. The actual ages for these laws vary greatly from state-to-state, as do the punishments for offenders. Many states do not use the actual term "statutory rape," simply calling it rape or unlawful sexual penetration. These laws rarely apply only to intercourse, but rather to any type of sexual contact. Dating someone without sexual contact cannot be considered a form of statutory rape, and is almost never illegal.
All states have an "age of consent," or an age at which a person can legally consent to sexual activity and can then no longer be a victim of statutory rape. Some states also have laws that look at the age difference between the two people as well as their individual ages. All states have laws that have restrictions on the relationship between the two people, changing the age of consent, or the penalty, for sexual relations between a person of authority, such as a teacher, assistant coach, or tutor. These laws change, and can vary depending on other circumstances. For more information on how these laws apply in the various states, try the Answer Board.
Statutory rape charges can be brought up by the victim, parents of the victim, and in most states, they can be raised by the state. California has been a major example of this, filing charges against fathers of pregnant women, at the protest of both the women and the parents of the involved parties.

Well, if you did the homework, you'd know that the mother can, and will, press charges against you for statutory rape of a minor, and if found guilty, you will serve up to a year in prison, if not, more, depending on the outcome and what the judge decides.
If I were you, I'd just lay low and not even think about having sex with this young girl, because of her age. Be responsible. Don't push the topic on the girl, until she's ready. And she won't be ready for another few more years!!
And damn, you need to find someone your own age, buddy! She's still considered a 'minor'!!

Hawaii law says that the mother's threat is legally empty because legal age of consent is 16 provided that the adult is 24 years of age or under. Some states, for instance Wisconsin does not make this distinction. In Wisconsin you would be charged with 1 count of 2nd Degree Sexual Assault of a child who has attained the age of 16. In any case, this is not a violation requiring the actor to register as a life time sex offender.

Yes you can be charged with statutory rape. Respect your girlfriend and her mom and wait. It is not worth it. If you really love her you can wait if not move on to a girl of legal age because you are just going to get into trouble.

Yes. You can go to jail. That is why anyone under 18 is called "jailbait"
Just walk away with your dick in your pants and move on. DO you really WANT to end up being tracked nationally for the next 15 years of your life as a statutory rapist just to have sex with a girl? Even if you love her???? Is it worth it to ruin your life????
no, walk away or wait for her to be 18.

I personally don't think they can do anything. Cause you are only 2 years apart. I got preg and I was 18 and my husband was 16. But when I had my son. I had turned 19 and my husband turned 17. Most states say 16 is the age of consent.

Any person under the age of 18 is considered a CHILD in a legal court of law...period. So mutual consent won't work. Better stick with Rosie Palm and her five lovely daughters for a couple of more years.

I really don't feel like checking the laws for Hawaii, but in GA the age of consent is 16. Check out the laws for your state at the below website.

Kill your girlfriends' mother before she's able to press charges...That way you will only be doing some time for murder as opposed to doing some time; getting raped yourself while in prison; and being labeled as a sex offender for the rest of your life, all for having sex with your girlfriend (which you haven't done!).
