I was working for consulting company which operates from NJ. I got my salary paid for most the period expect for last 1 month. They said they will pay me after they receive the payments from the client.

Couple of months after that, I spoke with the accountant and he has confirmed the receipt of the payments. I don't have any email correspondence though. Its been close to a year and they have not yet paid for my last month. All my phone calls and emails go un-answered.

Does anyone know, whats my options are here?
Any help or suggestions in this regard will be highly appreciated.

you need an attorney. Badly...that is illegal to say the least.

It sounds like you are going to need to take legal action to get paid, so hopefully you still have your copies of your time slips, which should have your hours on there and should be signed by some representative of the client you were working for.

Somebody owes you money, so it really doesn't matter whether it's the consulting company or the client, who pays you as long as you get paid.

Who know, maybe all you need to do is start to take the legal route to get paid and once that the consulting company sees that you are going to go that route maybe they will cough up the money. Especially, if it's made clear to them that if legal action is taken you will also be seeking legal fees and interest on the money they owed you.

If it does come down to taking legal action I would ask about going after the client for the money, so that you can start preparing for that if you can.

Good Luck.

I seriously doubt any accountant would reveal to youwhether the company has received payment from a third party. But then again, it's common practice for unscrupulous owners to refuse to pay if they don't think they will be using you again. You'll probably have to sue, but don't be surprised if the accountant conveniently forgets he ever had that conversation with you.

Speak with the Labor Board first and see what they can do for you. If nothing happens there, get yourself a lawyer and stick it to the man. What they are doing is highly illegal.

Go to your local labor relations board and file a complaint. They exist to settle labor disputes.
