I started a new job. I passed the drug test and the background. I was not on a probationary period at all. Can they come back a month later and release me due to their error on a background check? I had a felony check charge that they missed a long time ago>

If they don't want you to work for them they can can fire you for not telling them.

Did you fill in all the information that they asked for?

Did they ask you about committing a crime?

If you were completely honest with them on all the points they ask for then don't worry about it.

Yes, they can. Employees are employed "at will" which means that you can quit whenever you want, and they can fire you whenever they want, assuming the reason is not discriminatory.

Sorry you lost your job. Here's a suggestion for the next time: Write up a short statement about your previous charge, what the outcome/sentence was (i.e. probation, jail, dropped charges, whatever), and how you've been a model citizen ever since this early mistake.

I wouldn't present it at my next interview, but when it comes time to do the background check, you should give it to the human resources people first. It's better to be up front with something like this.

If you have to fill out an application that asks if you've ever been convicted, mark "yes" and "See attached explanation". Good luck to you.

The reason they did the background check was to find out if there were any felony convictions in your past. Because the results of that test weren't accurate at first, and the felony came to light later, doesn't invalidate their policy against hiring those with felony convictions in their background. They can do it.

You didn't "pass" the background check - you were convicted of a felony, and they didn't catch it before they hired you. It's called an "oopsie." Sorry, the test in this case was your background, and you don't get any do-overs with that - even if it takes someone a 2nd or even a 3rd look before they catch it.

Move on.
