I also never activated the card or used it.
The law of Ontario should apply as that is the choice of forum clause stipulated in the contract.

It would be unusual for the credit card firm to insist on payment, whatever the contract terms. Event the lowliest call centre clerk has the power to waive it. Don't take no for an answer. Ask to speak to the supervisor. Say that the advertising was deceptive and you will pursue the matter to the ends of the earth. Take names and numbers, keep a log of conversations. Send registered letters.

The only credit card that I am aware of, that charges annual fees are American Express. If that is the case, you will receive a refund on prorated basis, the annual fees you paid.

you dont have to pay jack on this card as long as you never activated or used the card you cant be charged..call them and tell them you never wanted the card and that you want it cancelled it will show up on your credit report though saying that you paid it off in full...actually makes your credit look better haha

Read the contract carefully and see what triggers the annual fee. You might have to pay it if signing up triggered it, not activation.

Always read the small print. If it was never activated, just burn it or call and cancel.
