How do I prove a father is unfit? He is a active gang member.?
My daughter is 7 months old and her father who has rarely been around is now trying to get 50% legal and physical custody of her. He is a active gang member and is now living with a new woman, her 2 kids, her mother and her brother. I dont have a clue as to who these people are that he is trying to have my daughter around. He was shot at in September but I have no proof of that.

Well--in and of itself this won't make him unfit--but the guy can't even support himself--he's living IN SIN with a woman and her two kids and her mom......so--you have the financial and moral issues right there as to why he shouldn't have ANY custody.

Be ready to combat all of the bad things he's gonna have about you though......and them if you have too---get him on the stand and ask him if he is involved in any gang or illegal activity. If he says no, fine--go out and get proof and then take him back to court--the judge will be livid to find out he's a liar and lied to him. You can ask him about the shooting--the worst he can do is say no....that's not gonna hurt you--did he go to the Hospital? If so, subpoena the records----honey you need an attorney.

Good luck to you----I'm sure this guy's attitude will be enough for the judge to know not to let him have shared custody. Does he have any other children? If so, has he failed to pay support for them? That would go to unfitness. You can get those records from the Child Support Enforcement......

Be ready to move away if you win and if he is a violent guy.

Did you know that he was a gang member before you got pregnant? He is still the baby's father regardless. Because he doesn't sound very stable, I wouldn't let my 7 month old child go to his girlfriend's mother's house either. If he pushes the issue then I would just tell the judge that I don't feel comfortable with him taking the baby until he gets a place of his own.

Ha ha ha, you women are sick in the head to try that ****. My ex wife tried to tell the court i was a active gang member, and that I am a danger to her and my kids. Ha ha ha, I laughed and said my past ( documented gang member) should not stop me from being a father to my children. Her lawyer fought his *** off because I was so called a shot caller. Although a documented gang member, I got joint custody, and visitation rights. No law says a biker cant have kids, thats a gang too isnt it. Oh wait, i forgot they are clubs, lmao!

The only way is to really find proof that he is in a gang. Even then i'm not sure if they would keep him from partial custody. Unless you could get him to sign over his rights but apparently thats not going to happen if he's trying to get custody.

You're going to need a good attorney. Does your ex have any criminal record? That would be helpful.
