I have a neighbor who is excessivly noisy. Both myself and the resident above him have complained. The leasing manager stated she is on it, but takes no action. Police have been called out 3 times now. What can I do to make the manager take action?

Keep reporting your noisy neighbor to the police. The more reports made and documentation the better. Eventually, the police will have to take it up with the leasing manager. They will make her do something about it, or else she will have to take it up with the courts! I was wondering how you knew for sure that she is not taking action? I mean, she could be acting on it but this guy just may not care. That's why it is better to just continue going to the police and filing reports that way.

Start by calling the local police, and file a noice complaint. If it is bad enough, which it sounds like it is, they will come over and pay a visit to the noisy neighbors. Continue doing this until either they get the point or management has to deal with the police. If that doesn't work out well, most of the time appartment buildings ect have a company or something that hires people to be managers in their many different buildings. My bf's old appartment had a sign right at the front door with the name and address for the company that hired the caretakers/managers for his building. Try getting that address and/or their phone number and contact them directly with your complaint not only about the excessive noice but also the lousy management in your building!

Read your lease carefully. You may be able to declare your landlord in breech of contract not maintaining a proper quality of life in the complex. State laws vary from state to state.

Again depending on the state regs, you might be able to do something like put your rent in escrow instead of forking it over to the landlord until the issue is resolved. Start by sending the landlord a certified letter demanding the problem be resolved.

The leasing manager has to have a boss she works for. Find out who owns the property & contact them about the problem. They should be able to put adequate pressure on her to take real action.

Threaten to sue and ask for all back rent if nothing is done. Find out who the manager works for and complain to that person. Make sure every complaint is in writing.

if you can show that she is not addressing this issue, you may be able to prove that it is "unlivable" and break your lease. also, depending on what type of noise, the police may be able to sieze whatever she is using to make the noise, which was very helpful in the case of my neighbor's rock band. they couldn't make much noise with no instruments or amps.

Take written copies of your first complaints and all subsequent complaints police reports ect. and get a lawyer. Take them to court to be reimbursed for past rent and use the money to move.

make sure police are giving disturbing the peace tickets and record the times and dates then give to management
