I ordered a tow and asked the tow company to call me 10min prior till there arrival. I left while waiting to go to an atm, when I returned to my vehichle, it was gone. I recieved no phone call and the tower did not have my consent to just take it without me being there. Is this legal?

But you called them to have it towed. By doing so, you gave them permission.

There is nothing illegal here--you asked them to tow the vehicle and they did. It seems that it is arguable that a condition of the tow "contract" was not met, but for this to mean anything you would have to have suffered some kind of damage from what they did. If they took the car you wanted towed to the place you wanted it to go, I don't see what harm their failing to call you first caused.

you gave terms and conditions to the tow. sounds like you got a free tow. Also, the law is behind them when it comes to towing anything. The car can be locked, in gear, parking break on, and they have all the tools they need to bypass that including the law. call them and tell them they broke the terms and threaten legal action

You requested for the towing of the car but made conditions. Thus, the tow company must abide by condition and what they did was not legal. Anyway, the request was only verbal unless, you prove otherwise.

Dispatcher probably didn't get this part to the driver. "Illegal" is a bit of a stretch, but poor customer service for sure. Driver probably thought he was doing what he was told.

Yes. Don't pay your car payment for 2 months and see it in real life for yourself even if you are in the car. Now, in most states if there is a minor in the car or its in a locked garage they can't take it.
