His widow has legal claim to his estate. Now if the daughter is receiving support from her dad, then she willbe paid from the estate til whatever time the divorce decree says he has to pay for. If theres alot of money, the widow can give the daughter a lump sum to end the support if she chooses, but get any agreement in writing to prevent problems.

The widow. But I think if she has any sense of decency, she will at least share the estate with the daughter. How much depends on the circumstances. If the widow helped earn most of the estate, then giving the daughter a quarter would be fair. If the husband had the bulk of it before he met her, the daughter should get half.

His widow will get the money you are the legal heir to his estate. If you feel like it you can give her some money. My husband died 2 years ago and his family thought they would get some of the money. To their surprise it was left to me.

Spouse will get the money....how old is the daughter? If she's an adult, she's not entitled to anything...if she was receiving child support...she may be entitled to payments or a lump sum...best to contact an attorney.
