WARNING: IT IS VERY DIFFICULT IF NOT IMPOSSIBLE TO REMOVE PARENTAL RIGHTS FOR NON-PAYMENT. THE TWO ARE NOT RELATED. (been there, tried that) Even if they don't pay, you can't deny them rights to see their child.

Child support payments should be going the Circuit Clerk's office if the paperwork was done through the courts. The best thing to do is wait until the parent has shown a significant pattern of non-payment. NOTE: It becomes a felony when it reaches a certain amount (I think $10,000). Contact your attorney who did the custody hearing and inform them of the infraction and what you'd like to do about it. This will cost you money. (Funny how the court says you must follow court orders but then the offender is in the clear if someone isn't able to pay to hire the attorney to show they've violated the court order.)

What you can expect: $500-$1000 lawyer fees.
2-3 months wait for court hearing. (You'll want to make sure you get the same judge who decided the custody in the first place. Good to establish support with the same judge.)
Expect the parent to have wages docked or go to jail for a time.
It may take 2 separate court hearings. One to prosecute non-payment. The other to reconsider parental rights.

I am not sure you can take rights completely away, but talk to your local SRS, or an attorney. They can help you get child support, no matter what, and if he wont pay up to them, chances are his *** will end up in jail, then you wont have to worry about visitation rights. An attorney or SRS might also be able to put their visits temporarily on hold until they do start to pay up. Good luck.

You probably wont be able to terminate their visitation rights completely but you can petition the courts to helpyou collect whats due you. Or you can contact your local child support collection agency for help.Now if youre hell bent on destroying his rights youll have to prove him completely unfit and a danger to your children with concrete evidence and not hearsay. Its not going to be easy. You can also contact your states legal aid assoc for free help or a paralegal or attorney if you have the funds. Just dont terminate his rights on your own or you may have legaltrouble to deal with. The law is on your side so use it to your advantage. Good luck and Have a fantastic new year

That is not legal in any state! Not paying support is not a reason to terminate parental rights! See an attorney and make him pay!

If he is paying child support, very slim chance! He would have to consent, so ask him/her. If he won't agree, very long expensive legal battle in front of you!

Tell your mom/aunt that you can't stand your husband/brother anymore and could she have dad/cousin throw his butt out!
