My beautiful baby boy was born in September via a c-section. During the procedure he received a spiral fracture to his left humerus and a haematoma (bruising mass) to his scrotum. I am angry that this has happened and have been informed that there is no avenue to sue the doctors repsonsible as I can't prove pain and suffering because he was a newborn baby at the time these injuries occured. I am not a money grubber and do not want to sue for monetary benefit. I just want the doctor to be held accountable. It is extemely rare for a baby to sustain a fracture during and c section and it is rare for a baby to receive a bruised scrotum so I imagine it must be exceptionally rare for a baby to receive both!!! My friend is a vet and has said that they pull calves out with tractors and they don't break limbs, so how rough did the doctor have to be for this to happen??? This happened in Australia and is more of a rant than a question but feed back from anywhere is very welcome.

in answer to OoOoo, no i don't believe it would be easy to cut some open and put out a wet slippery baby which is why you go to University or Medical school to learn how to do it properly!! If it was easy we wouldn't need doctors!

Thanks Z for your answer. You rant better than I do!! Your answer certainly made me chuckle!! My bub is a very happy little boy. The broken arm didn't hold him back as he started rolling over at 3 months!!
And yes we do have proof that it occured during the procedure as all ultrasounds and tests preceding the birth showed no signs of him being stuck etc.

I'm a nurse. I don't understand why you can't sue. I think you definitely had the wrong lawyer. I would get back on the phone, and the Internet and find someone. Girl the attorney tried to sue for the wrong thing. Pain and suffering isn't what he should have sued for but something else. It basically is the same thing but is worded differently. Don't give up. Your baby will indeed suffer in the long run, and who will pay for that. Keep going and never quit. There is someone out there that will help you. Try to get media attention if you are serious. That way the person that can help you will indeed come to you. Hang in there. Try to sue the hospital, ask a good attorney he can help you.

do you think it is easy for a doctor to cut someone open and pull a living moving slippery bloody wet baby out?

do you have proof that these injuries were not sustained before birth?

calves and human infants are not built the same, when a human baby is born the bones are basically like thick cartilage, the bones have not even hardened yet.

when a child is still in the womb there are many things that can happen to them, they can get their extremities caught on the mother's ribs or wose, through the ribs. they can even get hit on the mothers hip bones depending on how they are turned.

just be glad your baby was born with no major birth defects, the arm and scrotum will heal, it could always be worse.

dear, medicine is an imperfect science.
yes, doctors do make mistakes.
they can not be expected to be perfect 100 percent of the time.

lets look at it from another angle shall we?
Have you at any random time in your life ever made a mistake?
Ever?

People make mistakes, no ones perfect.
But, we all try to do our best under the circumstances.
If this doctor was a screw-up, then it is your mistake for not
checking him out first before going to him..

Otherwise, the doctor was just being human.
If you are still talking to the doctor, try going to him
and explain your concerns, maybe you can work out
something that will be mutually beneficial for both sides.

Life goes alot smoother if can work through our conflicts
and not leave a trail of misery behind us.

Because next to lawyers and politicians, many doctors are the next form of scum and vileness on the planet. With their God complexes and enormous saleries, they sit behind the protection of malpractice suits using the first mentioned spawn of satan to protect them via the defense of injuries occurring while doing the best job possible, and through no fault of their own. (which is usually bullshit) but hey, you never know if your getting a doctor who spent hours and hours studying until their eyes bleed to be the best, or one who is only a doctor because mommy and daddy paid for it while they parties and got high and scraped their ass by...

I'm really sorry,... I'd be really pissed too. Your a better person than I since I'd find the guy with a golf club and give him or her the first hand experience of those injuries...

I hope your son recovers, and I'm really sorry again.... :(

Suing the doctor is not the answer if you're sincere about not being a money-grubber. Every country has a board by which doctors are registered, licensed, and standards of practice and conduct are monitored. If you believe that the doctor committed malpractice, then report the doctor to the appropriate authority along with your evidence and let them decide if he was right or wrong.

In the U.S. you would have grounds, but in Australia..... Ya don't know, but if you got spare time then protest outside the hospital naming the doctor and the issue. This is not liable as it is the truth, but be careful. A advocate agency group might be a better method, but certainly to let it go!

I think Aus. has socialized medicine - if it were in the States - you'd be on your way to being a millionaire now.

That Dr. should not be practicing medicine, in my opinion.

Good luck - sorry to hear about your boy - but at least he'll be well over the issue by the time he is old enough for any of it to make a difference!!

Yeah you should just tell as many people as you can not to use that doctor. Perhaps you should write to the medical board - I don't know what they call it in Aussie land - basically the people who give them their licenses and tell them what happened and say that you don't think he should be practicing medicine. I'm sorry that happened. What happened to him? Is he okay now?

i would contact a lawyer and seek is advice on this, but im not telling you to sue,, just maybe he can help you report it to the hospital board in a formal way. and your friend is a vet, your child is no animal , hes a human bieng. or if you know another doctor talk to hm about it. good luck. but do seek a lawyer to help you.
