If the owners of a company want to cut positions and then add other ones, how can that be considered illegal?

If you were downsizsed your productivity did not meet company standards and they were being "nice".
Many states can terminate you "at will" because they just do not like you.
If you had a contract with specific performance goalsand met them you might have a case.
If none of that is the case then, learn and move on to a new job.
Many companies realign to meet new corporate goals; get rid of engineers and hire sales and marketing. Unfortunately, the engineers may be let go after they have come up with a killer product; short sighted but it happens.
I was the Marketing Director in a small division of a LARGE company. I brought a new product from womb to birth and it was a HUGE success.
I got a call at home from a friend of mine, another marketing director, and he said, "Start floating the resume because my company is going to acquire your division; they got tired of you kicking our "donkey". I couldn't introduce it, but I can take it to the next level, so you are going to be out. Just thought that I owed you a heads up".
We remained friends for years for years after that because we both knew it wasn't personal.
Lick your wounds, life isn't fair and business is worse. Get a new job and excel again.

What a great way to legally get rid of people you no longer want or need! Isn't business clever and loyal? Great way to get rid of those before they can retire as well!!
Should be the first hired, but if you have no union, wave bye-bye job!!
Legally, nope, unless you fall under an exemption clause under the American Disabilities Act, and then you should not have been let go in the first place!

Yes, you are legally able to start your own business and become a millionaire like hundreds of thousands of others. I too was downsized, now I am a real estate professional, truly working from home and well on my way to my first million. Couldn't have done it working for somebody. Taxes kill you when you are an employee. Your clientelle pays your taxes when you work for yourself.
