Christmas trees should definitely be up until the new year. According to tradition, you put your tree up on Christmas Eve and then take it down on 12th night (January 5). However, this might not work for a lot of people who put their tree up a few weeks before Christmas, and whose holidays are over before twelfth night. But I still think that your Christmas tree, and many other trappings of Christmas, should be enjoyed until at least January 2nd or 3rd. A few years ago I was at a shopping mall on December 27, where I watched janitors take down Christmas decorations. I almost found this offensive, as all it seemed to do was reinforce the notion that Christmas is just about giving and receiving material gifts.
Anyway, my answer to this question is not before January 2nd and no later than the night of January 5th.

After January 6, which is the "twelfth day of Christmas", also known as Three Kings.
That's if you follow tradition.
My mother actually left her Christmas tree up one year until almost Valentine's Day (February 14) because I was bringing my boyfriend home then to meet the family and she wanted him to see her beautiful tree. We walked in and the last needles hit the floor!

Depends on your particular tradition. I had a friend whose family were catholic and they waited until January 3rd (if I remember right), which is supposedly when the three kings left Bethlehem.
I like to wait until the "Birth of the King" weekend. Somewhere around January 8th. Cable television will run movies all day or several in a row that starred Elvis Presley. Or I pop in a DVD or two and watch/listen to his movies while I take down and pack up Christmas Decorations.

Most people keep theirs up until Little Christmas on January 6th. Others get rid of it as soon as it is dry, since it becomes a mess with all the dropped needles, as well as a fire hazard. Many towns have a tree recycling program, and residents will time the removal of their tree with tree pickup dates.

We have always taken down our christmas tree right after the ball drops on new years and we usually replace it with a new plant for the new year.

January 6th. That's All King's Day, or The Epiphany... the day the wise men are said to have arrived and given their gifts for the baby Jesus.
But really, take it down whenever you like. Not a major breach of etiquette in any case. If it's real, get it out before it becomes more of a fire hazard than it already is. If it's fake, it's really up to you.
