On christmas eve I was at work, and got a call from my boyfriend that are apartment was flooding, I had to leave work early which caused me to miss out on half a days pay, and holiday pay for xmas (because u have to work ur full shift the day before, xmas, and day after), anyway..the plumper finally got there and showed us the RUST hole that caused our apartment to flood (it was a pipe for the people upstairs water). The whole had been fixed before and several other tenants have had the same issues with there apartments flooding or leaks. So should I ask my landlord for reinbursment for lost wages, which equals the price of rent, so I should either ask for the money or just a month free?

the pipe has been "patched" before, and also our apartment is the only one with tile floors, all others have carpet so this apartment has flooded before..its the 2nd time its happened to us since living here ( we signed lease in Aug of 06).

my boyfriend IS on the lease, its our apartment, and no he couldnt handle it himself we had to move all our stuff so it wouldnt get wet, the water was ankle deep, and also renters insurance DOES NOT cover floods!!!!

boyfriend is from PA, and recently moved here he doesnt have friends or family here, the mataneice people were "not reachable" per our landlord...

Just going on your information given...but NO!!!
Your boyfriend was there right? And he called you to leave work?
Let's just say he isn't on the lease, I am guessing you gave him a key, so he had your permisson to enter the apt....so all YOU had to do if he wasn't on the lease was call the manager & report the leak & let them know that your boyfriend was there & could let the plumbers in.
You chose to leave work, and even if the above mentioned isn't correct,,, it's still a no, that's why you get renters insurance!

Yes Mam' Renters Insurance Does Covers Floods from broken pipes & water heaters!!!!! Have had a couple of tenants that used their policy!!!!!

Renter's insurance or not, you are not going to win. The landlord is not responsible for your personal belongings. They can show proof that they made an attempt to repair it. It was like an act of God that it broke again.
I will guarantee you that the plumber will never work there again after showing you something he didn't need to........................
He has no idea nor do you what the landlord has or has not done in the past to repair the problem. You will never win.
NOW...........Your employer is another story. That is where you should go. Obtain a letter from your landlord just stating the damage and the time that it happened. It wasn't your fault you had to leave and go home. Your employer should value you enough to pay you for the time you lost.
BUT, I would be very upset with my boyfriend. There was really no reason for him to call you home. He must have a friend or family member that could have helped him move whatever needed to be moved. If you live in an apartment complex I am sure the maintenance guys would have been there too.

#1. The plumber had no authority to show you anything. It wasnt your apt that the pipe was in. He will probably not work for your landlord again.
#2. Sorry, but pipes rust. Even if it has been patched before. It had to be leaking before the big "flood". It wasnt reported by the upstairs tenant and landlords arent mind readers.
#3. Its not your landlords fault that your boyfriend, who was home, couldnt handle the situation and called you home from work. That was your decision.
#4. You didnt say who called the plumber, so I will assume it was the Landlord or Maintenance people. They PROMPTLY took action, so you have no complaint there.
#5. Renters Insurance DOES cover your belongings due to damages from water due to leaks. The problem is probably how you addressed it as a "flood". Exaggeration will kill your claim faster than anything.
So in answer to your question, no the landlord is NOT responsible for your lost wages, there was an adult at home at the time that could have handled it. He is not responsible to give you free rent. Nor should he have to.

Renters insurance does not cover "floods" as in acts of nature. They do, however, cover "water damage", for example if someones toilet overflows in an upstairs apartment. That is water damage resulting from faulty equipment. Write your insurance company and tell them you have "water damage", NOT a "flood".
Your wages, however, cannot be recovered. If you get flat tire on the way to work, and you get there two hours late, who owes you? Answer: no one. Things happen, and if you aren't at work you don't get paid, especially if you leave voluntarily.

First off, when you decided to leave work at that time, when really you could have waited until the shift ended. I would say no, unless your state has a time limit for your landlord fixing things, or he has fixed it without any experience that caused you damage.. My words would say why would he owe you money? if you cant answer that, then no.. Check your local laws, one state can be stupider than the other.. If it looks like it has been a major problem that has been half assed, I'd look into what you can do.. I would let the land lord know, and record anything that is sent..

You're wrong.
Renters insurance DOES cover damage caused by flooding from broken or burst pipes.
Floods as in a river overflows and then floods your place is not covered by regular renters insurance but only by special renters flood insurance.
Submit the claim on your renters policy and ask your landlord to reimburse you for your deductable.

NO silly ..your make a claim through your Building insurance or content insurance that you taken out in case of damages done to your property ie water or fire damage..
Who is this crap company you work for who wont pay you holiday pay ..because you left your job 2 to 3 hours early ..to attend a major crises ..I can't see that .but if you say so!!!!!!!!!..no not even if you say so

Aiyee! sounds bad -- if you know the landlord you could ask as it would be the decent thing to do -- if its a corporate run and managed outfit, don't get you hopes up, I doubt they have to do anything other than repair it
P.S. I'd start looking for somewhere else to live, sounds like a time bomb....
