I have been living here for about 8 months and everything has been fine until my boyfriend politely asked the girl downstairs to lower the volume of her music. She had been blasting for 2 nights in a row... (she only acts up when her husband is not around, brings other men into her house, while he is at work and her 1 yo is asleep). She agreed to lower the volume and then after 30 seconds she rang our bell like a maniac and started threatening to have us killed and make us move, if that makes sense. We called the police and filed a complaint. the police saw how beligerant and drunk or high she was. We also told the landlord who basically said that that wasn't like the girl and she never caused a problem before and pays rent on time.(this girl has senority &she didn't care) Last night she blasted the music at 3am and I called the landlord and she basically gave me the impression that she didn't care and did not want to get involved. What can I do to stop this without having to move?

The landlord is good when it comes to fixing things but doesn't seem to care that she crazy...it seems she only wants her money. I don't want to move because I like the place and love everything else about the place...what can I do legally to get this landlord to do something to straighten out this crazy lady?

I don't know if a noisy neighbor qualifies as a "nuisance" in property law. If she is a "nuisance" then you would not be able to do anything, other than call the police and have them handle the "disturbing the peace" claim. Even if she is a "nusiance" in property law you would be unable to do anything because you moved to the nuisance (a.k.a. she was there first). If, on the other hand, the "nuisance" moved to you, you would be able to get an injunction ordering her to keep her music at a reasonable volume level.

Because, she was there first, however, the issue is moot. I suggest calling the police based on her disturbing the peace.

Every time she blasted the music I'd call the police and have them come investigate your "disturbing the peace" complaint. After a few times of this happening, the landlord might decide to do something.

well first off if she is making death threats then that is harrasment. i would try the voice recorder if she comes to your door in a drunken rage then turn it on and conceal it so you can get a recording but she wont see it. maybe you should speak with the police again and alert them that she is continually causing a disturbance. they may "stake out"near the house a couple times to moniter her. if she is causing any problems call the cops pronto dont confront her too much or she may try and get you kicked out which she has no right to do. really all you can do is keep making complaints to the cops because obviously the landlord is biased twords her. you could also try speaking to her husband alone if you think he will believe what his wife has been doing.

Your landlord has an obligation to maintain certain standards within the apartment complex. Generally, these standards are detailed in your lease. What I suggest you do it submit your complaints to your landlord in writing along with copies of police reports. The landlord has an obligation to do what she can to provide a decent living environment. Thus, she will have to take action on your complaints. If the issue continues with no effective action from your landlord, this can be considered a violation of your lease contract by the landlord. It is helpful if noise stipulations are detailed in the lease. If the landlord continues to fail to address the issue, you can get out of your lease for free as the landlord has violated this contract. You may even be able to sue for moving costs.

However, this is a tricky situation. Noise may not be considered a factor of the environment that the landlord must address. It might be tough to get this through the courts. If you wish to pursue this route, check with city hall or the courthouse or a local housing authority to find out what actions you need to take to deal with it legally.

What I suggest is that you submit the complaints and police reports to your landlord in writing. After that, speak with your landlord about ending your lease (no charge to you) because she is not dealing with the issue. Explain that she will either have to deal with the issue, let you out of your lease for free, or you will take her to court.

Call the police when the music is loud early in the am. Have them experience it and again knock on the apartment and ask they lower it. Keep having reports made as evidence to your landlord of the poor behavior. Give the reports to the landlord. Best of luck.

When music is played loudly between 10pm and 7am you should 1st bring to the attention of the neighbor, 2nd bring to the attention of the manager, if those fail call the police. If somebody knocks on your door and makes a threat, immediately call the cops. I would also find out if other neighbors have been disturbed and enlist their support.

There is several ways to go about this. A. both you and your husband could carry a voice recorder around with you at all times in the event she does make threats on your life the police will have the proper evidence to arrest her. B. You can continue to file complaints with your land lord but i doubt that will go far.C. What might work the best is to capture this womans "boyfriends" on video or capture a few pictures of them and show them to her husband....i am sure he'll leave her..she'll move out..will be the end.... no more worrys

Find out where hubby works. Next time she is alone with another man, call hubby at work and give him an anonymous tip. When he gets home and catches her skank butt, he will toss her out - and your problems will be solved!

start doing subtle but annoying things to her like glue on her doorknob and stupid stuff like that endless mindnumbbing tourtre really works
