The data on a CD is actually on the reverse side of the top surface. The disc protects the recorded surface and gives it shape. The reading laser must pass through the disc undisturbed. The quality of the player can also be a factor. If the laser hits an imperfection on the disc it can deflect the laser from reading the disc causing a playback error.

With both CDs and DVDs if you really have to put them down somewhere (i.e. not back in the box) then put them down writing side down (although some DVD are double sided so this doesnt work), but the best advice is to transfer them from box to machine and back to box :-)
If you dont like the boxes, then you can buy very cheap carry cases for 20, 40, 80 etc CD and again this will keep them good - the only time I have ever had a CD/DVD get scratched is leaving it out of the box - my CD/DVD player has never done this
As for repair - if the scratches are really deep you can buy kits with sand paper in - you have to do it carefully but it works....but if the scratch goes through to the mirror underneath then you have had it

Actually it takes considerable effort to scratch a CD. More commonly a CD gets a little dirt on it and can't playback properly. Usually wiping down a CD with a lens cleaning cloth will fix the playback problems.

I don't know, but you can buy some special ones that have triple layer of scratch protectant on it. It should help in preventing scratches. There are also products you can buy to repair scratches. Check Wal-Mart.
