i went into a restaunt with my family last night and the service was lousey then our hostes says she is sorry but she has been sick since the day before then i go to pay for it im over charged for somthing i did not recieved the manager deducts it and agin apoliges and that his employ was sick then hours later geuss what now im sick

It sounds like the manager of the restaurant did all he needed to take care of your complaints. Who says you got sick from the waitress? Maybe you got sick from the person at the next table--not the restaurant's fault.

You have no proof that the sick waitress was the cause of your sickness let alone the fact that you cannot document or prove that any of the above really happened.

Depositions could discover that the woman was sick, and that you were sick just after, but you still have to prove that SHE made you sick AND that she caused you enough hard to cost you monetarily before a jury would even consider granting you a reward. IF you made it to court and IF y ou won, expect a payout of $1.00

You complained to the manager, who fixed the problem.

Since you know the hostess was sick you should have started washing your hands, using antibacterial soap, and other preventatives so you would not get sick too. It could also be coincidence that you got sick after that meal.

Why would you need to sue?

Yeah the manager should have sent the hostess home (or she should have stayed home) but suing would be stupid.

You have no case. Any attorney who would agree to represent you is just stealing your money.

Look at this objectively: If it was possible for people to sue others for getting them sick with flu/cold, then wouldn't there be a huge crush of lawsuits during flu season?

Suck it up and move on. We all get sick from time to time. It is a part of life. That hostess or restaurant don't owe you anything.

probably not, unless you can prove beyond a shadow of a doubt that you got it there.

Honestly, why are you even thinking about doing this? If you had just waited, you would have gotten your food. I wouldn't award you a single cent.
