If a woman told a man before having sex with him that she was unable to get pregnant should a man be responsible for paying child support? He wanted her to have an abortion or give it up for adoption and she wouldn't do either. Now she is trying to come after him for child support. Is there some way around this mess?

He may possibly be able to petition the family court to terminate his own parental rights. If he has already gotten behind with his child support payments, he will still be responsible for what he owes, but possibly will not have future payments. There is no guarantee that the court will allow him to terminate his rights, but if he doesn't want anything to do with the child, that is an option that he may try.
Unfortunately for the child, they will grow up knowing that their dad, never wanted them. If he really didn't want any kids then
he should have been more cautious and used protection whether the girl said she could or could not get pregnant it's sad that in circumstances like this it is the child that suffers, not the ones that created them, not to mention, was he just hoping he wouldn't catch some kind of disease, maybe she said she didn't have one and he believed her there also.

There should be, but, unfortunately, there's not.

The system is completely unfair to the man. If a woman gets pregnant, she makes all of the calls. She can have an abortion, give the kid up for adoption, have the kid and never even tell the man, or she can demand financial support.

I am so sick and tired of the "best interests of the child" argument. The best interest of the child would be to not keep it unless it's wanted (abortion or adoption). There is an adoption waiting list 10-years long for healthy babies in this country. A woman should not be able to trap a man like this.

And, why does his income dictate how well this woman lives? It only takes a certain amount of money to raise a child. That should be the absolute maximum a woman can get for child support. If she wants to live better, let HER get a stinking job.

Quite a few deadbeats claim that the woman lied. But if that were an argument for not being held to pay child support then all men everywhere would do is claim this and lots more women would be stuck paying 100% for the child and more men would escape responsibility. Just because a man says a woman said something doesn't mean she said it.

More than likely no. All birth control is not 100% effective. One of his boys could have gotten thru, he should have used his judgement and used protection instead of taking her word for it. is he dumb or what. I am a female and I hate when other females try and trap a man with that "I can't get pregnant" crap. It's just plain wrong and it gives us other women a bad rap with some men. Unfortunately she'll get the child support, but god will show her in the end what her lies may have caused.

I thought you said he didn't know about this child. The first thing you both need to do is get a grip on the truth. You need to accept that this kid is the product of both his and his ex's poor decision making skills and forget how or why it happened. He has a child. He needs to step up and provide for that child. Period.

Unless someone simply does not have the necessary organs to have a child, then we all know that no statement saying the woman can't have a kid is a fact. Who is supposed to support this child, if not the parents?

If a man is stupid enough to believe that a woman can't get pregnant and he chose not to use birth control just so he could feel a little better while doing her then yes he should be responsible for paying child support. Each person having sex is responsible for making sure no baby is concieved. Not just the woman.

Nope, no way out of it. after DNA proves its his, he pays until the child is done college. It’s a long hard road for the mom too, raising a child is not only costly, but at times, extremely stressful.

you would think he would just want what was best for his child, unplanned, unwanted or not. child support is there for a reason; the honor system doesnt work.

in any case, here are some link with GREAT child support info (and any other info you may want for him) on them. just click on your state, and find the section you are looking for.

It is a mess. A lot of women "think" they can't get pregnant simply because they haven't before- big mistake.
The law is if the child is his, child support will follow. The best thing is to get a blood test, he's probably not the first person she's told that to~

The end result is a child that needs taken care of. he should have used protection. She has pulled off what is gaining popularity today as "Insurance". A woman will get pregnant by men (usually with good earning potential) and doesn't want marriage, but wants the support. this can add up to quite a tidy sum. Men need to beware of these pariahs. They are out there and they prey on men who don't insist on using protection.

the man is responsible for paying child support. shame on the woman, however, if dna proves it is his child which he will pursue i'm sure, then he is responsible and unfortunately stupid. unless he has a lot of money and some cunning lawyers, he might have a case. but, i blame him too, it takes 2. sounds like they are both immature. it is a human being here. people stop being lame about sex.
