Someone has a public defender appointed to them in Wisconsin for criminal charge. However, in the meantime, they have an eviction case filed against them.

Is it legal for the public defender to also represent them on the eviction case?

The cases are completely seperate. In Wisconsin, the only way you can get court appointed counsel is for criminal cases - not civil.

I'm a paralegal who owns real estate now. My question comes up because I have a tenant being evicted for not paying rent but she currently has a public defender for criminal charges.

When her attorney comes into court, I want to have some legal basis to have him removed (as a tax paying citizen AND for my benefit in the eviction proceeding).

Well, if he's doing it as the P.D., it's probably not OK, but he may be volunteering to handle eviction cases pro bono (many lawyers do this in our community, particularly around the holidays).

Public Defenders are for criminal charges. Can you imagine the caseload if taxpayers had to pay for PDs to handle civil cases for the dregs of society? If a public defender is handling an eviction case he/she better be doing it on their own time.

The Public Defender can represent your tenant if he wants. There may be a case against him for fraud if he charges the county for representing her in the civil case.

No. You must pay for your own lawyer for civil cases. We taxpayers can't support everyone.

You wouldn't want the same lawyer anyway. Every lawyer specializes in some area of the law, and, if they don't know the specific laws for a situation, they are not helpful. Would you want your OB/GYN doing your foot surgery, or a podiatrist?
