It depends on your age and the jurisdiciton. If you are a juvenile it will be treated that way. And in that case if you have not other record it will probably be diverted and you not even get a juvenile record.
Even if adult--if a first offense in most places you can avoid a criminal record by paying some court costs. At most it is a minor misdemeanor--punishable by a couple hundred dollars at most.

depending on the state where this happened but in MI, the alcohol was in your car so if the car was registered in your name, it's in your property so you may as weel have been drinking it too. plus if the others were minors that is not good.major fine, again depending on your state law. alcohol in a moving vechical without a ligor licence is bad and a big fine.next time just stay at home or if you go out never have open alcahol in your car. were you driving? MAAD is very powerful in the US so beware, it's for the rest fo your life on your record. even though the lawer may say after seven years NO not true it will always come back to hunt you. Remember a vecicle is a movining machine runned by man.

If you are under the age of 18, you have nothing to worry about. The law is too lenient on underage drinking in most jurisdictions in the United States. Worst case scenario is possibly probation or community service for 24 hours for first time offense. Hopefully the biggest scare is when your parents find out the story.
Maybe that officer taught you an important lesson or perhaps it's time to select new friends. Just be glad your car wasn't impounded because you would been paying your parents back a lot of allowance money. The key thing to remember is be honest with your parents and yourself and never drive with anyone who has been drinking. The risk is just not worth it.
Don't be afraid to call your parents if your at a party and things get out of hand either. They may be mad that you called them in the middle of the night, but it's worth it to them knowing your using your skull and not driving drunk, or riding with an intoxicated friend.

Lets take a look at it, for what it is;
(1) we all know, that you know, that you're a minor in the eyes of the law, at least you realize that much.
(2) any one of you or your friends, could have also created additional problems from your underage drinking. I've personally seen people stopped by police, who turns out to be minors, for Disturbing the Peace or aka, Disorderly Conduct and arrested, maybe one may slip by, but, admit that will be rare in where I live and work. Even adults find it hard to get away with DUI and open containers in a moving car today.
(3) you also had other passengers in your vehicle with you at that time, you could have injured or kill someone, in your vehicle or some other vehicle, traveling innocently along. Suddenlly, a bunch of young teens causes a deadly collision, along with serious injuries for some of the survivors.
(4) what you said also means and imposes, that you were previously involved with some kind of fraudulent act like...
(a) > possibly using an illegal ID,
(b) > doing a beer run (stealing and running away with alcohol) a theft,
(c) > involved in shoulder tapping (asking an adult to make your purchase) for alcohol.
(5) you probably also lied (perjury-a felony) your way out of it with the police, you are lucky that is all that happened to you, you could have got yourself and your friends all arrested, and your parents car impounded.
I HOPE YOU UNDERSTAND THE SERIOUSNESS OF YOUR ACT. HOW IT COULD HAVE POSSIBLY CHANGED YOUR'S OR SOMEONES ELSE'S LIFE, FOREVER.
TAKE THIS FOR ADVICE, GROW UP AND USE THIS AS A EARLY LIFE LESSON FOR YOU. YOU STILL WILL NEED TO FACE YOUR FAITH WITH THE COURTS, DO IT KNOWING THAT YOU WILL NEVER DO THIS STUPID DANGEROUS ACT EVER AGAIN. You're going to get a small fine, probably less than $500. You can't be arrested for MIP, at least not in TX. If you really want to fight it out, go to court and pray the cop forgets to show up.
