I am currently renting a 1BR apt month to month. I have paid in full for December, and January rent is due January 1st. However I have found another place I would like to rent and would like to move out before Jan 1st and not have to pay January rent.

Because my lease is month to month am I allowed to do this? Or do I have to give 30 days notice? Is there a usual protocol for month to month leases in this sort of situation.

it all depends on your lease contract-but 30 days is the standard i would say

When living month to month it is customary to give a 30 day notice. I am assuming you do not have a lease. This gives the landlord time to advertise the property and try to have a seamless cash flow. With the current housing slump, rentals are booming. A lot of people who are ready to buy are currently renting. They are waiting to see if the market is going to continue to drop or if it has leveled out. With such a hot rental market, your landlord may not mind such short notice. They may even be able to get more rent than you were paying.

You probably have to still give a 30 days notice. Or else you get charged for another month of rent.

Unless your lease specifically states otherwise, you must give 30 days notice even on a month-to-month lease.

i think u still have to give 30 days notice...I know at my apartment even though we go month to month we are still required to give a 60 day notice...which is bull **** since we pay an extra $30 a month to do it...but i would recommend checking the lease agreement u signed...or asking the person you are rentin from.

Most leases even month to month require you to give one month's notice. Check your contract.
