Unless you want to download them illegally, yes you do have to pay. The games on the apple site are the legal ones.
There are sites that offer free games, but once again its illegal. A quick google will turn up a few results.
Don't trust all the sites that say free though, occasionally it may require some registration or may cause viruses.
But please do notify me if you do find a good site, I would love some new games for my Ipod Video.
