As far as I am aware, you can move anywhere within Great Britain without him gaining a court order, but he should be aware of what you intend to do in advance expecially if he has regular contact with his child, as this is going to make contact a lot more difficult, although not impossible. I think its only if you take your child out of the UK that he could gain a court order to stop you. I know my ex can't take my children out of the UK without my permission, so I could go to court and stop him. Hope this helps, and if you do move, good luck with your new life in Scotland.

what is the reason behind wanting to move without asking?
even if you and the dad do not get on - which may appear you do not considering the nature of your question the most important thing you have to think about is the relationship between father and son?
how will this move affect your son and his relationship with his dad?
despite what could be your bad feelings towards the dad think about your son's feelings please
ask citizen's advice or someone like that before making a decision that could have profound consequences for all involved.

Judging via that actuality you have used the be conscious 'toddler' could recommend that your toddler wasn't born till now April 2003 that's while automatic parental household projects have been offered to the father if he replaced into on the childs beginning certificates. you may show there are greater con motives than professional motives for her shifting. If no longer the rest, going to courtroom or searching for criminal suggestion will placed you able that if she 'did' pass, she could could conform to you vacationing or her vacationing decrease back to your daughter to bypass to you. do no longer forget approximately, no rely how a great way away, daughters and fathers have an extremely specific relationship which could no longer be in comparison with the different.

The fathers permission???
England is still supposed to be a free country, so in theory you don't need anyone's "permission".
I'm assuming you aren't currently living with the father, and that you are planning to tell him about the move in advance though. This is a social nicety though; you don't actually need anyone's permission.

the father can take you to court to stop you moving, this has happened to my partner with his kids.
She wanted to move to France with her new man and take the kids with her,my partner sought advice and was told he could take her to court and stop the move based on his visiting being sufficiently effected.
She was told she couldnt move without the fathers permission.
I dont know how it would work from England to Scotland as its still in Britian but you should seek advice,go to a solicitor, you get a free half hour consoltation and also visit the c.a.b(citizens advice beurea

My cousins partner moved to England with their daughter without telling him and he is distraught he had the worst Christmas. It is legal if the custody is with the mother but otherwise no.
