my girlfriend is almost 16, almost emancipated. are we going to get in trouble even if she gets emancipated?

If she is emancipated, she can file statutory rape charges herself. So you better be sure that this is the relationship you both want.

Right now her parents still have the right and depending on the state, they might retain it. If they can prove that you had sex with their daughter before the emancipation takes place, you are done for.

To my understanding it is not legal for anyone under 18 to have sex, unless married. But that doesn't stop very many kids these days. When a minor becomes emancipated they basically are declared an adult, they can sign contracts, and they are no longer under the protection of their parents. In other words their parents are no longer financially or legally responsible to take care of them. If you have questions ask the judge presiding over the emancipation.

Statutory rape has nothing to do with emancipation. Statutory rape means that she is not of the age of consent for sex. That does not change if she becomes emancipated. She will still be underage and not able to consent to sex.

How old are you? She is 16, let her finish growing up before making such Huge life alerting decisions.

If you are 18 or older and her parents push the issue, you could go to jail.

It depends on the age of consent in your state. In my state it's 16 to consent to sex.
