I want to sue my former employer. He mistreated me horribly, harassed me on and off the clock. Mentally abused me. As well as come very close to assaulting me. Ultimately forcing me to quit. I knew it was wrong while i was working there, but now, im having a lot of after effects.

Do i have a case?

First step to take is to contact your local EEOC office and file a complaint for harassment.
Also, check to see if you had a "arbitration agreement" with your former employer. This can be upheld or smacked down. Higher courts have gone both ways with this.
After the EEOC finds in your favor, then you should begin civil action against your former employer. I think you have 6 months.
Get an attorney that specializes in this area. You should be able to do the EEOC filing yourself, but an attorney might be able to add something you didn't think of.

I feel for you...but mental abuse and after affects are very hard to prove. Post traumatic stress could come from child hood etc...at least that is what their attorney is going to use. I would go through the state and file a grievance on your employer. I would not pay an attorney to fight it unless they find reason. Why put yourself more in a whole of debt. I had a work injury that this top notch company swore I made up for months....after several arbitration's, I had three MRI's that all said the same thing, and it took over 2 years to even come to court. To this day, I am still being treated and I have to jump through hoops just to prove pain factor even with medical technology on my side. good luck

It's not what you know happened that wins cases.

It's what you can PROVE happened.

There isn't enough information here to decide whether you have a case. Have you seen a psychiatrist about your stress and mental abuse? Did anyone witness the harassing incidents? Did you discuss them with anyone as they occurred?

I'm not sure what you mean bu "close to assaulting." Did he place you in reasonable apprehension of offensive contact? (That's lawspeak for "did you think he was going to touch you inappropriately or hit you or worse?") Did anyone witness it?

Did he document any shortcomings in your performance (deserved or not) and counsel you on them before you left? It might look bad if he had been counseling you on performance and then you quit and file suit for unproven, unwitnessed stuff.

Just some thoughts. Talk to a lawyer in a free consultation if you like. I wouldn't be optimistic unless you can prove the harassment.

Probably you have a case, but here's what I tell everyone. When stuff happens at work write it down, the date etc. Better yet send a company memo to someone, this way there's a record of what happened. My guess is you're going to have to get other employees to come to your aid, this might not be easy. Most people don't want to go against their boss because they might get fired.

Sounds like it but just to be sure contact some state officials you may need to file a complaint with your local sheriffs office and also it may be to late you should have done it as soon as it happened but GL anyway

yes if you kept a detailed notebook of events with dates, time, and witnesses. Your case is very difficult with out this, unless you know others are or did go through the stay type of treatment from this person and they are willing to cooperate with you.

Sounds like ya do to me just from what you say here, but consult an attorney and contact Labor Relations in your area too.

File a complaint with your states human rights office. They will not only let you know if there is a case they will also provide lawyers at no cost.
