if I get charge with dis. conduct, i 3 kids at home and my 2 youger kids have lost there grandmother, older brother last yr., there father is in prison, and there brother just moved out.so i am scared about jail cause of my kids and what it will do to them

usually yes; cases involved with actor as mother, it can be at the discretion of the prosecutor and the court. Do not try this without an attorney. Hire one...your children need you more than you can afford not to shell out the money.

disorderly conduct is a minor offense and in some states is not a subsequent violation, warranting probation violation stipulation or arrears of the suspended sentence.

If you do not have an attorney, ask for a court appointed attorney..although usually not the best attorneys...they do have a law degree and have some experience.

Much depends on the violation. If you do have to serve jail time, your children will become wards of the court and be placed in some kind of care. It may be tough, but children are adaptable. It is sad that it must be this way, but one has to follow the law.

Maybe you should have thought of them before you did whatever you did to get a violation.
