Sorry to tell you but I had the same troubles with my Ipod. Apple Ipod first generation or second and third had that problem. Every time I would upload new son'gs it erased those that were on the Ipod. I had thankfully extented warranty, and Apple admit that they had the problem. There was even a lawsuit filed. So what they did they exchanged it since it was under that warranty. However, still I have troubles with that darn thing. Now I got a new Ipod and it automatically uploads it but never erases the songs that are already on em. Nevertheless, I hope as a smart consumer you have purchased the warranty, and if you still happen to have the receipe go to the store or call Apple and they will send you a service free package. You put your Ipod into it, and mail it for free. Good luck. Hope that helps.
