Well, if the truck broke into the room and was threatening the person on the third floor (especially if the truck had a weapon), it was probably self-defense. If the guy was just out shooting trucks, it is his fault and you should call the police. If the guy on the third floor was under the influence and the truck refused his advances, it was the truck's fault for leading him on.

No, the person on the third floor with the gun is responsible. It's a disgusting trend in the US that people want to sue a corporation because they've got money, rather than going after the low-life responsible for something like this, who has no money. That's not justice, it's profiteering.

The guy that shoot your car is responsible and your insurance knows that and they will try and get you to get some one else to pay.Do not let them suck you in.You have to get the guys name from the hotel owners and get a police report from the police then send that to your insurance and they have to cover it.Then they pay you and the insurance go after the criminal that shoot your car.So you have to do a couple of things to get your insurance but then the insurance company will go after the guy that shoot your car.I hope this has been help full.
