I know it drops of the driving record, but am unsure about the criminal record.

You are asking two different things. A DUI conviction can be used as a prior conviction in order to make a later conviction more serious. This used to be for 7 years, but has recently been raised to 10. However, even if it cannot be used as a "prior," it is still on your record. Even if "expunged" under Cal. Penal Code section 1203.4, if it is within the priorable period it can still be used. And California "expungment" does not really get something off your record--it will show a conviction and relief under PC 1203.4.

It doesn't even drop off of your driving record. It's just that, if you get another DUI after 7 years, it will count as your first regarding punishment levels.

Get the expungement or it will haunt you forever. It's worth the money.

the DUI on the criminal record does fall off after 7 years. i still recommend an expungement. HOWEVER, the DMV which is a whole different set of pancakes will keep your DUI on their record for 10 years.
