the first time i was sleeping and my mother had stayed over and was also sleeping but in the livingroom when the landlord walks in with the fire department doing inspection. the the 2nd time i was taking a shower with my partner n i just happen to finish when i herd a loud knock on my bathroom door when i opened it i stood afront of my landlord and about 8 other people he said "i forgot to tell you i was showing the apartment today?" is this legal?

Absolutely not! You as a tenant have certain rights and no landlord can simply barge into your rented apartment as he/she pleases. Even with the fire department present, he needs to ensure you are OK with it, and especially with showing the apartment to other prospective renters. The landlord cannot invade your privacy by simply barging in as he/she pleases. You can sue your landlord for this.

First off, moat places the fire department doesn't even need his permission. Any official city agency can claim "inspection" etc. Almost everywhere he has to give you 24 hrs notice. If he was with the F/D he probably knew ahead of time, what kind of inspection ? As far as showing the apartment, same thing, "forgot" is not an excuse. In my state the landlord can actually go to jail for it. As a renter you have more rights than you think, check the lease, however just because it is in the lease doesn't make it legal...:-)

When a landlord rents property, he or she gives up the right to unrestricted access except in case of an emergency.

Tell your landlord that the next time there is an unauthorized entry that you will file a trespassing complaint.

Even if your lease does say they can come and go as they please, it would be contrary to state law in almost every place and therefore it is unenforceable because you can't sign away your rights.

If I were you, I would have pitched a major fit and called the police on the landlord already.

I would check my lease but, in most States the landlord has to give you a 24 hour written notice when he's going to come in without your O.K. He just can't "walk in" like he has, Remind him people have been shot this way.
I was a landlord to 125 four plex condos this happen to me, I walked into the wrong one,by mistake, I was looking down the barrel of a .45 automatic.
I did notify my tenants but, it was a mistake here. This can happen.
With the fire department inspecting ? I don't know but, he just can't walk in like he did.

Yes, this should be illegal. Your landlord is supposed to give you 24 hours notice before coming into your house. If they are knocking on your door, then you may invite them in. It IS okay to tell them, "You did not give me any notice and I'm currently unable to let you show the apartment." You may want to read your lease agreement though. I know in my mom's restaurant lease agreement, the owners of the building say that they can walk into the restaurant anytime that they want, without notice. We had to take them to task about that though, because you cannot break the law with a lease agreement, which is what they (and possibly your landlord) are doing by invading your privacy and space whenever the mood strikes them. Think of it this way: you are renting "ownership" of that property for your durration there. People from a mortgage company for a house that someone owns cannot just waltz into a home unannounced just becuase they approved that person for a home loan. Same concept. Good luck.

Everyone is telling you what they want to be true, and it most cases, it is. Most states require 24hr notice, some states even more. However, some states (including mine), do not require any notice at all.

Check your local laws, then your lease. If you laws say he can enter any time, but the lease says he cant, you can still fight him. If they both say he can enter any time, you should have read the lease more carefully before you signed it.

Pretty sure ,You can obtain Booklet's , Truth in Renting is for tenants and Landlord in N.J.These booklets contain all the rule's that tou need to know, by the way they are to be givin to you by the landlord! I believe every state has simular rule's check online in your state . in Jersey it is kind of wide open with each circumstance ,check your lease, for any right of entry info!

Not in California. He has to give you a 24 hour notice unless there's an emergency of sorts. You can buy a slide dead bolt lock so this can't / won't happen again. A slide dead bolt can only be locked from someone inside. Cost is under $10.

look at your lease. the outfit i used to do maintenance for stated in their rental contract that the land lord, or his agent (maintenance man) could enter the dwelling at any time for any reason, with out notice....if a tenant changed the locks, they were evicted for breach of contract(without any notice) and ticketed for vandalism.

of course, i would knock loudly, enter the dwelling, and announce my presence before i went very far in. i never did want to see another mans wife naked, or get shot.

you need to talk to your land lord and ask him politely to do something similar. dont go in with a chip on your shoulder and start whining about your rights or things will only get worse.

you need to look at your lease and your towns laws on renting but in general the landlord has to give you at least an hours warning.
