As I am applying to UVa, I am asked of which state am I a LEGAL resident...I just moved to WV from Va in August. What makes me a LEGAL resident? My family still owns a house and land in Va. Can I claim that I am a Va resident? Thanks for any help you can give me!

My son moved to Missouri stictly to attend the college of his choice but kept his Illinois driver's license and home address. He was living with me at the time in Illinois. I think you have a choice on which you would rather be, as long as your parents still reside in Virginia, you could go either way. Please check if there are more benefits afforded to you by being a resident of Virginia or West Virginia before making a decision. With my son, there were more benefits in staying an Illinois citizen.

Your status is not dependent upon where you family own property, rather is depends upon where you reside and how long you have resided there. Some states require a year of residents before you qualify for instate tuition, other only six months. Whenever you change your residency form one state to another you have to get the new states driver license to the new state within a certain time frame, usually a month, or else risk get ticketed for driving on an invalid driver license. You also have to be able to prove that you have lived in the state for the required amount of time; you can use utility bills, telephone bills and the like to prove your residency. Check with the school for their conditions for instate tuition, if it is a private school there might not be a different between instate and out state. If you could show that you lived at your family's property in Va I am sure that you would not have a problem.

Technically, you are a legal resident of whichever state you reside in. However, where is your drivers license from? VA or WV? You could still claim residency in VA since your family owns property there, but you should really reside there to claim it legally.

If you don't want to pay out of state tuition, use the VA address. Each state specifies their conditions for residency. Don't change license to WV.

What do you claim as your legal / permanant residence ?
You probably need at least 6 months of residency to be
legally classified as a resident..
You may need utility bills or something to substantiate your time
of residency....You will, of course, need a drivers license from
your state of residency.
