Under the Religious Freedom Restoration Act of 1993, if is for a legitimate religious purpose, yes it is. But if you are forming the church solely for the purpose of having cannabis, not it is not.

Under the first amendment you have a right to create that church.
Under the theocratic majority that have hijacked the government your church would be labeled a cult and the government would go burn your church down just like they did at Waco.
