I don't want to know about HOW TO GET A DIVORCE, I want to know if I am divorced. I tried to pay for one and at the time my husband wouldn't divorce me , but now that I have been gone for so long I wanted to know if HE divorced ME> and how I could find out if he did . UNSTAND ??

At least in the US once you marry, you stay married until and unless one spouse obtains a divorce or dies. Together or apart is immaterial.

The law is a very weird oddity. If you cohabited for over 5 years you are (in the eyes of the court) married, however, if you have been separated for 5 years they (the court system) still think you are married. Just get to a lawyer or to the county clerk and find the fastest cheapest way to finalize this thing! I guess that after 5 years you don't have to worry about his stuff/ her stuff any more. So it should be easy, just don't expect it to be quick. It never is.

You have to pay a lawyer to get divorced or you can type it up yourself. Either way, it isn't free and the papers have to be file in court and a judge has to sign them.

No your not divorced unless you or your partner filed the proper paperwork with the court and you or your partner received said paperwork to allow you to agree to the terms of the divorce or contest..............Then you go before the Judge and he or she determines if your divorced or not......When the judge agrees to your grounds and tells you your divorced then and only then is it official....

Being apart doesn't make a divorce. If you haven't received papers indicating you are being sued for divorce then you're not divorced. I suggest you seek legal counsel.

No - you are just seperated - you have to go to court to file for the divorce.

nope...sorry...you have to actually get a divorce legally to be divorced.....call a lawyer....
