My cousin was stopped by a cop about a week ago. He was suspected of "intent to distribute." The cop searched his car, but found no drugs. The thing is that the cop opened a couple cheeto bags and snicker bags thinking there were drugs inside. He also broke his lighters.

Like I said, he found nothing. Can my cousin do anything about this, can he have the cop pay for the opened food.

An illegal search could be charged against the cop and can even request for the payment of the damaged food if proven that it was conducted maliciously and without any valid reason under the Penal Law.

I doubt you could do much, since I doubt the damage is more than $20. Is it worth to sue. You can file a complaint, but I'm not sure on the response. If they mess up your car by dumping cheetos in it, its a different story. The question is why did the police stopped your cousin. They can't make random stops. You can take action on that part.
