I broke up with this guy 3 months ago. A month after, someone put sugar in my gas tank (hmmmm, guess who). I know it was him cuz he admitted to damaging another womans car for not paying him back money. I said I saw him do it and I filed charges against him. Than I dropped them cuz I didn't want to be bothered and I want to move on.....even though I know he did it.

Now he wants to sue me for destruction of property for a torn rug and a scratched counter top. Also for harrassing phone calls when we were having a fight while we ere dating.Does he really stand a chance against me?

Whilst this feels quite stressful, it is really an annoyance as opposed to a threat of legal action. The case lacks real substance both from a damages and case strength perspective.

I would not fear that the case would move forward. However jot down all issues and calls any contact you have with him.

When speaking with people, joint friends etc, be gentle say things such as "no, he is just a bad breakupper"
It will ensure that he is just seen as being small when he is arguing about minor issues.

On a final note though be careful about your own safety, guys generally are emotionally cripple when it comes to breaking up.

The question isn't really whether he can sue - people can and do sue over all sorts of things. The question is whether he can sue and win. And that's a kind of "who knows" question. Did you tear his rug and scratch his countertop? Whether or not you did, what kind of "proof" does he have?

The judge may be less concerned about pettiness than evidence.

I recommend that you go look in the phonebook and look up lawyer referral services. Sometimes you can get an initial half hour consultation with a lawyer for around $30, and get some answers about legal questions. Some law schools may have upper-level students who'll perform legal consultations as well.

Level with the lawyer about what's been going on and see what he or she has to say.

Then “Joe Man” must be your boyfriend, because he just posted this SAME question an hour ago from the male point-of-view.

Although, honestly, every time I see this happen I wonder if it’s the same person, and they’re just hoping to get a different answer if they ‘pretend’ to be the other party. I’m not saying that’s the case here, but…

anybody can sue anyone for anything basically, however the judge makes the final decision on who wins based on the merits of th case. If he can prove the damage, he might win that part, on the phone calls probably not.

yep, I heard it straight from a devils (lawyers) mouth...anyone can sue anyone for anything......that is why are justice system is so screwed up....thanks to all the lawyers who have been voted into our legislature....
