My father is a veteran of the vietnam war. 10 years ago he had 2 strokes and was put into a nursing home by the state becuase they found my mom not fit to take care of him. I was wondering when he dies who will take care of the funeral and will the state get all of his money. I was told my father had over $50,000 in his estate but i dont know if im eligible to get any money out of it.He has a lawyer but she is a b**** and wont let me look into his estate. He is my dad and i visit him every weekend.What are my rights?

Also im not greedy . My father cant talk and hes is paralyzed how is he going to sign or say anything about what he wants.My mother is in prison. Im the only one that visits him

to start with i want to say how sorry i am that your dad is in bad health. And please tell him for me, "WELCOME HOME". now i have given you the best places to get answers. The 1st has places to click to find info on Vietnam vets . the second is the Veterans Admin. and the 3rd is to make him a quilt block, so that he will always be remembered. *they dont have to be gone to make up a block. You may be able to get him, $ while he is still alive for illness due to service related also.And tell them he needs a computer to stay in contact with you.you will be amazed what he can get from the government. Find a VA rep in your area to sit and talk with , find a VFW post.thats what those guys are there for, to help. and to pay visits to your father if he would like. I hope this has helped. Its a long hard road to travel alone, I know. Been doing it for over 10 yrs now.With little help alone the way. HUGS and Hoping for things to work out for you.

The cost of nursing home is around $3,000 a month $50,000 won't last long even if from it only partial payments are made. That lawyer you call "*****" is doing her job and is looking out for your fathers rights before your own. Besides I smell greed here, the man isn't dead, is laying sick in a nursing home, and you worry about getting your hands on his money like a vulture? You should be ashamed of yourself.

You really don't have any rights. Your father evidently wants to exclude you and maybe your mom from his estate. Otherwise he would be sure to write you as a beneficiary in his will or trust. That's solely his discretion or that of his conservator if one has been appointed due to his mental incompetency, if any.

The best thing to do is to talk to a lawyer and also see if your father has a will. But talk to the lawyer first.
