Laws in Oregon require that a dissolution of marriage is legal if you have certain criteria. One of those is less then 15K in debt, Papers have to be served by a third party, and there cannot be any kids involved.. there are a few other things but I can't remember. Since we were 35k in debt, the papers were never given to me, and he lied to the judge to get her to sign the papers before the 90 day waiting period was up, does that mean our divorce is not legal and we are still married? Do you have any suggestions on what I can do? I don't want to be divorced. Legal advice? Anyone???

Call up the city or county clerk and tell them this information-and they will direct you-many places will show you were to make out papers to protest or to insure it comes out right. relax-I am praying for you-been through it too-my x cheated on me-and had anger issues-she cried before me sorry and I cried too-she got rid of her divorce papers but refused to take anger managment-so when I was served papers the next time-when I went to protest-they said I had to pay120$ to stop it-I figured if someone wont do what is right-even though she still adored me and was trying to protect me -I let it go and there was no debt involved or asking for money-so it was all cool. and I am free and she remaried without taking anger managment-so she is his problem now-peace in Jesus amazing grace that saved a wretch like me=John 3 repented of sin and been born again. Gloriously made new! and happier than ever-not feeling rejected-she rejected Jesus and true love from him and from me too-it wasnt rejecting me-nor you either see the big picture-you have a life-chose who you will serve-make it the joy and peace of Jesus-and answer my 3 questions ago-what does Christmas mean to you-only 2 bad answers so far. thanks alot

Do you already have legal council?
I could recomend a few good firms in Oregon if you really believe he will be different towards you.
Kind of sounds like he cut and run, how long has it been since the divorce? I know once a judge has judged that most other judges don't want to hear about it. I am not a lawyer, but I think that I have heard that it has to be the same judge that ruled before to change the ruling. May God bless you, and bring you what you need to be at peace.

If he's bound and determined to be divorced, divorced you shall be whether you like it or not, probably. A dissolution is more or less a "friendly divorce" that's quick and dirty, where both parties agree to it and basically there aren't any strings attached. That's why you can't have the kids and there are stipulations on money, etc. But if he wants out and you want to fight it, he can still divorce you. In that case he sues you for divorce and each of you are going to fight over the pickings. But the judges almost always grant the divorces since one of the parties wants out regardless. It's more of a matter of how things get split up.
My advice? I know this is harsh and hard for you to take......but he wants out and he's getting out regardless. Rather than lose your collective shirts in legal fees, you may as well find the fastest, cheapest way out of it (dissolution if possible), put it behind you, and move on as quickly as possible. Get a lawyer Every State is different. If the judge signed off on it. ..your divorced. Here there is a six months waiting period no matter what..until its legal from the time each of you are served. You have to be notifed legally and be served papers to be apart of the divorce but if its on record somewhere that you were served...your screwed.

The divorce was not valid because of the 35k debt and it was not even process. Thus, you can file for support against your spouse.

I don;t know about the laws in Oregon. Best to consult a lawyer.

Why do you want to stay in a marriage that is not working? You are the only one who wants to be in it or your man would have stayed married to you.
