Dutch 21 London, senior sales. I've been with a company for a long time now and am a valued employee. wages = 4.55 hourly. Since 3 months we have a new boss, he loves me, I hate him. A few of his new rules scare me: The end of the day if your till is down you pay for it from your own pocket & If you make an error with a buy in, you pay the difference. One of my (newer) staff made an error and she was being bullied to tears, it was downright disgusting so I stepped in and took the blame. My question: Can this be done? Can I be forced to pay 70pounds? What if I refuse? What if I sue for all the other money they owe me (I was on 4.33 for months by mistake and still trying to get that back) I swear if I got Health and Safety in we'd be shut down in a second, we have roaches and everything. I want to quit for months now but I'm concerned about my staff. They are the reason staid, I'll even go so far to say they are my family, but I feel powerless now. Can my boss do all this?

You can't do much on your own. You will find the boss is holding all the cards. In business it's profit first and lip service to anything else.
If you have a case against the Company, collect evidence and enlist the help of the Trades Union. The general rule is that errors are made up by the operators, however, with the vast amount of money now going through tills, I should think that a more enlightened company would have a indemnity policy that does not put the burden on one person.
The only exception would be if it is obvious the money has been filched.
However, standing surety for another is costly. Christ stood surety for us and see what it cost him.

Thats terrible, i feel like family to many of the the staff i work with at my company.. as for the pay Shotage, i was being paid wrongly for 5 Months on one occasion, i only found this out untill one of my collegues who is the same age as me was on more.. so i confronted my Manager, who i know has had it in for me for months... and he tried everything to make sure i was on this low pay still... the funniest was ''your contract has been established for over 3 months, any mistakes should have been rectified within the first month of your contract''' so i told him that i would get in touch with the Union.. it wasn't long before my next payslip shown the correct rate of pay!!.. i think you should confront your manager and be straight with him.. tell him he needs to get his act together and care for his staff, rather than just to take in the money.. because in the end he will end up causing his own customers danger... scare him that if H and S gor involved he could get into much trouble.. good luck though!!

I don't think they can not if its retail. Do you share the till with other people because if you do then they should check it everytime a new person comes on. Your not even on minimum wages I would go to your tribunal if you haven't got one then look up for them on the internet I think you should sort this out cause it isn't right.

He can do that....as long as he stated these rules before the situation happens and you still stayed with the company then it would appear to him that you was ok with the new rules. Roaches??? Maybe you should look for a new job.

you need to get in touch with ACAS,
You also need to bring to his attention any Health and Safety issues you have seen, if there is an acciddent YOU can be prosecuted for not making your employer aware, health and safety is Employer & Employee's responibility.
By the sound of it you would be doing yourself and the other staff a favour be gettingn him shut down

Your new boss is attempting to change your tems and conditions by imposiong these new procedures on you. this si something he cannot do without your agreement and the agreement of those who work in the establishment To deduct money out of wages fot till shorts would amount to an unauthorrised decuction from wages, soemthing your boss is not allowed to do. you can not be forced to pay the £70 if he deducts it from your wages without your agreemet this would be recoverable through an employment tribunal. if yiou refuse to pay and he sacks you, again theis would constitute unfair dismissal (depending on length of service - need 1 year) and you could again tyake him to tribunal.
the interesting one here is the ehalth and safety concerns youi raise. Your emoployer has a duty under law to protect the health, safety and welfare of ist workers (including protection from harassmenta nd bullying) if they fail to do this and an employer feels they are in danger at work they can refuse to work in the establishment (and still be entitled to full pay)
your concerns above should be communicated to the environmental health department, in doing so you would be priotected from dismissal through whistleblowing legislation. if he dismisses you or treats you unfavourable because yopu have reported a breach in law (namely Healtha nd safety) to the autrhorities, you would be able to again claim at tribunal, unlike unfair dismissal claims, awards for whistle blowing dismissals have no cap and can be unlimited.
with regrads to back pay, again you can put in a claim for unauthorised deductions from wages, its simple to do and you do not have to leave, if he sacks you beacsue of it you will again be able to claim unfair dismissal for ascerting a statutory right.
there are many issues here with many possible claims at tribunal. I would suggest speaking to the CAB or specialist employment law solicitor. do not suffer in silence and dont let him get away with it!

I don't know whether he can make you pay shortages but when I used to work on the buses I was sometimes short.The money was then taken out of my wages. It makes sense otherwise people could just pocket money.

In the US the only LEGAL way they can do this is if you signed a form allowing your company to take out money from your check. Check your laws and see.

ok.... why aren't you on minimum wage?
i have never worked in retail but the rules you mention are bollocks, tell the bos where to shove the short change.
is it written in your contract you must pay back? i doubt it.
kept those wage slips? go see your solicitor about the underpayment of wages.
