From the article on Chris Gardner on ABC's site:

"The word "happiness" is deliberately misspelled, just as it was on the wall of a day care center where Gardner once sought care for his infant son, Chris Jr., during some of his worst days."

"The word "Happyness" in the title has been intentionally misspelled. This is significant to the film's plot. When Smith's character sees a teacher at his son's daycare center writing the words "The Pursuit of Happyness" on the outside of the building, he tells the teacher that the children misspelled happiness on the Declaration of Independence. The teacher notes it is not important whether or not happiness is spelled correctly, but if the children have it. These words motivate Christopher Gardner to lead a happier life for his son. "

There was a scene originally supposed to be in the movie (but was cut) that shows children writing graffiti and one of the words was happyness. They were told it was spelled wrong and the kids said it didn't matter you knew what it meant!!
