I lost my cellphone in a crowded nightspot. The next day when I called my own number, a person finally picked it up and he hung up when I told him he has my phone. I called again and he had switched it off. I made a police report the day after. A few days later, I finally managed to find out who the person is.
I had contacted the person online through this Friendster account, however he did not reply and I know he had logged in to his account as he has new testimonials. I sent him a message again, telling him if he does not reply to my message I shall report him to the police.
He is a 15 year old. I was wondering would the police do if I reported him. Someone told me I was the one who was careless so maybe the police can't do a thing. But I feel that this is theft as I made contact with him via the phone and he acknowledged he has my propery by hanging up and switching off the phone. Furthermore, he gave out my number to his friends thinking he can use it.
What would the police do?

I had suspended my phoneline and managed to retrieve it that is why I managed to find out who he is through his friends who had text messaged my number.

now what he has is my phone. I told him to either return it back or compensate me. But he did not reply.

BTW I know his name and school and even have the numbers of his friends.
I had suspended my line the moment I realised it's lost, and then activated it only to contact him. And I got it replaced soon after so I doubt the bill will be outstanding. I still have my number but he can't leech on it anymore.

You should definitely report it at least. Most likely the police won't do anything or at the most, they will question him about it. But, you probably won't get it back. But, you should report it just so the little punk doesn't think that he can get away with things like that with no repercussions whatsoever.

It's theft. I'd report it.

But, first, I'd call the phone company and tell them that it's been stolen so that they can suspend your account, and let them know you're making a police report.

You'll need the police report if you have insurance on the phone. You're phone company might replace it if you can't get it back.

One witness is all you need to go to the cops, and you actually talking to the person probably counts.

You should file a report with the police department, you may have been "careless" or whatever, but the person who obtained your phone knew that the phone didn't belong to them. Not to mention that you informed them of that information (as if they didn't already know) when you called "YOUR" phone. The police have to take a report, you can contact your district attorneys office to find out if you can in fact prosecute this person. Good luck to you...

If you lost your phone, someone picked it up and took it for his own use, this is called "Misappropriation of Property " under Sec 403 Cap 224, with a max. sentence of 2 years imprisonment, or with fine. But, as the offender is only 15 years old, normally only warning will be given.

Yes, it is theft, or some similar criminal offense. The police might or might not do anything about it, depending on their workload. Since the thief is a minor, the penalty would probably not be much - unless he is already on probation or supervision.

I think you should file a complaint with the police.

Ok he has your phone and its lost/stolen...so he is possession of a stolen article....file report and get your phone back....the police will go to his house and get your phone back....

since he is 15, if the law does anything at all, they will give him a slap on hand...unless he has a record, then it might be more serious.
