The Executive Branch [President] can request or propose a bill to Congress, such as the Patriot Act, or Civil Rights Amendment.

The Judicial branch makes decisions based on the laws already in place. There have been cases where the courts have stated that a law needs to be revised, clarified, or even created -- cloning, transplants, internet, etc. -- but any ruling must be made from the existing law.

NOTE: Individual states may have different policies, because of their Rights to self-rule.
