While there are 100 senators, only 99 will be attending the opening of the Senate in January. Senator Tim Johnson of South Dakota remains in the hospital following surgery to correct a vascular problem in his brain. This leaves the Democrates with a bare one vote majority, if as expected Senators Jeffords an Independent from Vermont continues to vote with the Democrats. Democrates 50 votes, Republicans 49 votes. If Senator Johnson were to die, there is every possibility that the Governor of South Dakota, a Republican would appoint a Republican, which would turn control of the Senate back to Republicans, as VP Cheney would then be casting the tie breaking vote.

100, with two from each state. Although I think it should be at least 101, because the residents of Washington D.C. have no representation. They're not considered a part of Maryland, and aren't afforded representation in the senate or house as a seperate state.
