my employer told me since i couldnt do the exact job i was hired to do, that i was taken off the schedule. Yet i am under a drs care and have weight restriction and no overhead lifting. there are other things i could do. but i was immediately put back into the same position and expected to do the same stuff prior to my injuries. any help with this would be great

You should really talk to a lawyer. Most have a free consultation and can tell you if you have a case or not. You don't say but i think alot of it depends on wheter or not you got hurt at work. If so, you definately have a case. However, if it happened (got hurt) away from work then they may be in their legal rights.

Absolutely not legal, get a good lawyer, they will take the case on contiguity(sp) I don't know what state you reside in, but employers are suppose to change you're position due to you're injuries-- that's if you were injured on the job. Good Luck. Oh, and watch out, you will be watched, and with all the new camera phones, if you get caught so much as carrying a jug of milk, you could loose you're whole case

If you were hurt on the job, it is illegal. i was hurt (minor injury to my finger) almost 2 weeks ago and my boss cut my hours from full time to 21 hrs. per week. I am seeing an attorney on Thursday after the holidays are over. GL. Hope you find the answers you need, Happy Holidays

Time to call a lawyer - in most states you can not be let go if you are under doctors care.

A lot of this depends on HOW you were injured. If you were injured on the job, then you probably have rights. But if you were injured on your own time, then your company probably has no legal obligations.
