Adultery, is strictly and historically defined as consensual sexual intercourse by a married woman with a man other than her lawful husband; meaning only the carnal intercourse of a wife with a man who is not her lawful husband. Both the married woman and the man, married or unmarried, are considered guilty of adultery if they engage in such an act. The intercourse of a married man with a single woman is not accounted adultery, but philandery.
In some jurisdictions, the definition is altered to include a married man who has sex with a woman other than his lawful wife. Common synonyms for adultery are unfaithfulness or, in colloquial speech, cheating. It was also known in earlier times by the legalistic term "criminal conversation" (another term, "alienation of affection", is used when one spouse deserts the other for a third person). The term is not related to adult (Latin a-dolescere, to grow up, mature), but to Latin ad-ulterare (to corrupt).
The sexual partner of a married woman committing adultery is often referred to in legal documents, especially divorce proceedings, as a co-respondent, while the husband whose wife has been unfaithful is often labeled a cuckold. Originally, the latter term was applied only to males, but in more recent times women have sometimes also been characterized in this way.
A marriage in which both spouses agree that it is acceptable for the wife to have sexual relationships with other men is termed open marriage and the resulting sexual relationships the wife has with other men, though still considered adulterous, are not treated as such by the spouses.
