I assume you filed a complaint with eBay, if not, you need to do that. And how did you pay for it? If you used PayPal, you may have recourse there. If you sent a money order, it's gone. If you used a credit card, notify the credit card company. And did you leave bad feedback?
This is not really prosecutable by law. The seller is in one state, you are probably in another, although it is interstate commerce, unless it involves a LOT of money, no one will prosecute this. Live and learn and be more careful next time. Just remember, it isn't eBay, it's an individual who did this. eBay only gave him or her a place to sell merchandise.

I'll tell you what I do, I'll take up with the security people of eBay and let them know what happened. Still nothing then I take it up a notch tell eBay I will drop the account with them If they don't do any thing fast. They need to call the police and have him arrested.

just file a complaint with ebay
file a complain with paypal if you paid by that form
post a negative to his feedback
and move on with your life
