She can go to court and have it changed. But it will cost a good amount. When my Mom wanted to have mine changed. The courts agreed to do it but it would cost 1500. dollars. And that was a long time ago it might have went up since then. She should just blow him off.Or get a DNA test it would be less of a hassle. But at any rate in the long run it would be easier on your little brother to leave his name has it is.It gets kind of old having to explain why you name is different from you siblings. And for you brothers sake if I were your mom I would give your dad an attitude adjustment. It is child abuse to do to your little bro. What he is doing and it could have long term effects on his self esteem.

Yes, she does have the legal right to change his last name if she can prove to the courts that your brother is not the son of your father.

You all need counseling and a DNA test. Yes, she can go to court and change his name for about $600-1000, but unless you get a DNA test, legally his dad is your dad. Changing a name proves nothing.

If your mom knows that who that that is his kid then she can keep the last name whatever she wants to. If she changes it, then she giving in to her ex-husband and denying her son's birthright. Even if he doesn't support the kid, she doesn't have to change the last name to make him feel better.

wow that sucks sooo lets see... mom and dad have you and your brother ((and various other children)) and your dad says your bro isnt his so your mom wants to change his name since your dad is in denial? i think you should talk to your mom about it... maybe figure out if your bro really is or isnt your dads... what would his name change to... your moms maiden name? a stepdads name? i think the best thing to do is talk to your mom about it tell her how you feel and see what she has to say and wait it out

She can go get a paternity test to prove he is your fathers child first, then force child support and if she wants she can get a lawyer to change his name legally. She can change it anyway, but I would want to prove the paternity.
