If both of your names our listed as owners of the house , you have the right to do as you please , but the co-owner can always seek action to stop you .

I don't know about subletting a room but l am curious to know how you two are coping living in the same house. My husband and l tried that when l found out he had been cheating on me. Our children are all grown up only 1 at home and we have 4 b/room house, so space was not an issue. l just found it very uncomfortable at times. I am just curious , thanks. Merry Xmas.

Not advisable. If both of your names are on the mortgage, I'm sure you will have a hard time explaining such a move.
I'm curious; what state ALLOWs separated couple to co habitat?
If you are still living together, doesn't that defeat the purpose?

actually,my husband and I are doin the same thing right now.I don't think you need consent,but since there is a child involved,you should let the other person know where you're at.Also,consult w/ a lawyer,different states may have different laws.Good luck!

NO!It is probably illeagel and even if it was not you would have to split the child.That will only cause stress.My parents are divorced I know what it is like.

isnt part of seperation not living together and being seperate. becasue thats is not happening you need the others consent.

depends if the lease is in both of your names...
if its in solely yours, then yes, you can.
if its solely in his/hers- then no, you can't
if its joint, then you can, but the other can petition not to allow the tenant to move in
