i really don't see a decent argument of adultery being legal.

marriage is a social "contract", and if two people pledge to each other that they will be faithful to one another, then by breaking that contract, you extremely effect the other's life (in a negative way).

wouldn't people think twice if they had to pay 10,000 dollars for sleeping around?

my question has no religious context. just the breaking of a social contract.

what if people were offered a contract when getting married? if you signed it, you are pledging to be faithful and allowing yourself to be punished if found guilty.

if, when one gets married, one is offered this contrct and refuses to sign it, aren't they saying something about their intent?

it is illegal to break a verbal contract. how is this no different?

No, I don't believe we should make adultery punishable by a prison. We wouldn't be able to build prisons fast enough to hold all of them. I don't actually think adultery can be held completely accountable for someone who is on low income, or has been to prison. In my opinion drugs and alcohol play a much bigger role in that. I agree at how your raised has alot to do with how you succeed in life. However if a person has the determination and the will to be better than that, they will. The reason I'm saying this is because I am one of those people who had just enough determination to do better. When I was growing up in the late 80's, my father had been shot and killed by my brother and I witnessed it. I was not even 10. Alcohol played a huge roll in that. So here I was a kid without a father and a mother who never drank in her life became an alcoholic. We never had money for anything. I overcame all that and was dedicated to getting out of that lifestyle and making something of my life. I did just that. I think you have a good debate but I just don't agree.

If someone in a marriage has sex with someone else should not be against the law because govt would have to make it to a law, need to vote on it, waste tax payers money, etc. A social contract is just that a social contract, not legal. Marriage is legal when it comes to taxes, loans, etc. What happens during the marriage is not the govt problem, but the two in the marriage.
When one cheats on another in a marriage its sad, painful and should not of been, but usually its a problem in the marriage, and should not be my problem or anyone elses.

What penalty would you consider appropriate? If you are talking about a contract, then the only remedy is damages and termination of the contract. How would you assess the damages? And do you want to further encourage divorce?

Adultery is illegal for Democrats but its ok for republicans, Example, Bob Livingston, Newt Gingrich, Henry Hyde, Dan Burton, Bob Packwood, Storm Thurman Rudie Gullinia john McCain and the list goes on and on.

The fewer the laws the better; keep the government out of our lives! Laws are not meant to save people from themselves, they are to protect us from others. All the victimless crime laws (drugs, prostitution, gambling etc) are foolish and a counter productive waste of time. Fidelity laws would take the cake!

I think it should be illegal but it will never happen since there are so many people that are guilty of it. It hurts lots of people.

It really bothers me that people that have affairs feel like they have to tell their spouse. Maybe it's to clear their mind and sole of guilt. However, that innocent person doesn't need to know. The guilty party should live with their guilt and not burden others.

It's a free country. You cant punish people for that, that is WAY to strict, people would start hating the country. That would be stupid, people should not do it, but thats a little bit extreme

It could only be illegal if someone included it in a pre-nuptial agreement, thereby they adulter would be in breech of contract.
