does that mean that the orginal parent has the right to sue againts social service for 5 million dollar. also is it right to gain riches on a wrongful death.

If the child was "taken" from the biological parent it was a result of a petition filed against the parent for abuse, neglect and/or abandonment in which could result in prosecution of the parents. The state only assumed responsibility when the biological parent failed to meet basic needs of the child or caused iminent danger to the child. However, once the court granted custody to the state, it became the legal custodian of the child. Your question of whether or not it is wrong to sue for wrongful death may be best answered with another question. Who allowed the child to become vulnerable by having it leave the protectionn of its parents and home in the first place? Ultimately, who failed this child most?? Hmmmm.........

No, because if the child was taken away from the birth parents, then they were doing a piss-poor job. So they can try, but the courts will most likely tell them they are SOL.
