Call XBox Live and contact there support.
I prefer to Call them instead of E-Mailing them.

Tell them that you want to close your account and why.
Most of the time you have to wait untill you've paid the $50 dollors, some times you can just have them close it down.
I had to wait untill my Gamertag expired.
Now about changing your gamer-tag name.
Yes, if you use the same e-mail adress you may create another one. I actually created 3 with the same info i had on my first one.
